Terms of Service

These Terms of Service ("Terms") govern your access to and use of PropPeek ("PropPeek", "we", "us") at proppeek.com and related services (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old to use the Service. You sign in using Google, and you are responsible for activity that occurs under your account. Keep your account secure and provide accurate information.

2. The Service

PropPeek aggregates publicly available Malaysian property data (including bank auction listings, affordable-housing schemes, and NAPIC sold-price transactions) and allows registered members to publish their own property listings. PropPeek is an information and listing platform. We are not a licensed valuer, real estate agent, financial adviser, or party to any transaction between users.

3. Member listings and content

  • You are solely responsible for the listings and content you submit, and you represent that you have the right to publish it (including any images) and the right to market the property.
  • Your listing details and the contact information you choose to display are published publicly and may be indexed by search engines.
  • You must not post content that is false, misleading, fraudulent, duplicated, unlawful, infringing, or that you are not authorised to publish.
  • You grant PropPeek a non-exclusive, worldwide, royalty-free licence to host, display, and distribute your listing content for the purpose of operating and promoting the Service. You retain ownership of your content.

4. Moderation and verification

We may review, approve, reject, edit, hide, or remove any listing or media at our discretion, with or without notice, including to enforce these Terms. Any "verified agent" status or badge is granted at our discretion and may be changed or revoked. Listings may require approval before becoming publicly visible.

5. Acceptable use

You agree not to: scrape, harvest, or bulk-extract data or contact details; submit spam or send unsolicited communications to listers or leads; misrepresent your identity or affiliation; interfere with or disrupt the Service; or use the Service for any unlawful purpose.

6. Aggregated and public data

Property data such as sold prices, auctions, and affordable-housing listings is compiled from publicly available sources such as NAPIC and government/agency portals. While we strive for accuracy, we do not guarantee the completeness, reliability, accuracy, or timeliness of any data. Nothing on the Service is financial, legal, valuation, or investment advice. Always conduct your own due diligence and verify information independently before making any decision.

7. No warranty

The Service and all data are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, PropPeek and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of (or inability to use) the Service or any data, listing, or transaction facilitated through it.

9. Indemnity

You agree to indemnify and hold harmless PropPeek from any claims, damages, or expenses arising out of your content, your use of the Service, or your breach of these Terms.

10. Intellectual property

The PropPeek name, logo, and the Service's design and software are owned by PropPeek. Except for your own content, you may not copy, modify, or create derivative works without our permission.

11. Third-party links and services

The Service may link to or rely on third-party websites and services (e.g. Google, Supabase, Cloudflare, map providers). We are not responsible for third-party content or practices.

12. Termination

We may suspend or terminate your access at any time for any reason, including breach of these Terms. You may stop using the Service and delete your account at any time.

13. Governing law

These Terms are governed by the laws of Malaysia, and you submit to the exclusive jurisdiction of the courts of Malaysia.

14. Changes to these Terms

We may modify these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
